Batoo (the "Platform" or the "Service") is operated by BATOO S.R.L., registered office at Corso Venezia 54, 20121 Milan (MI), Italy, VAT 14748130961, contact email giorgio@batoo.it ("Batoo", "we", "us").

Batoo is a listings portal showcasing boat profiles published by users, brokers, or shipyards ("Advertisers").

Batoo is not a party to any sale, and does not handle payments, shipping, or technical/legal checks.

All negotiations take place outside the Platform, directly between prospective buyers and Advertisers.

Certain features require an account via e-mail or third-party providers (e.g., Google, Apple, Facebook).

Using social login authorizes Batoo to receive the minimum data required (name, e-mail, avatar) per the provider's policies.

You must be at least 18 years old and are responsible for safeguarding your credentials.

We may suspend or terminate accounts that violate these Terms or the law.

"Content" includes text, photos, logos, descriptions, and technical data uploaded or submitted to Batoo.

By uploading Content, you warrant you hold the necessary rights and that it does not violate third-party rights or applicable laws.

You grant Batoo a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use and display the Content to provide and promote the Service.

Removing Content does not prevent temporary persistence of technical/backup copies.

• Posting false, misleading, or deceptive information (e.g., bait pricing, mismatching photos).
• Infringing others' rights (IP, privacy, trademarks, trade secrets).
• Uploading malware, performing large-scale scraping, or using bots to manipulate ranking/metrics.
• Bypassing security measures or interfering with the Service.
• Posting illegal, obscene, defamatory, discriminatory content, or promoting unlawful activities.

Advertisers are solely responsible for accuracy, completeness, availability, condition, origin, and compliance of listed boats.

Prospective buyers must conduct their own inspections and due diligence before any decision.

Batoo does not guarantee truthfulness nor perform independent verifications.

Contact forms forward your details to the designated Advertiser (and, where needed, to our technical providers).

The Advertiser will handle such data under its own privacy policy. Batoo does not oversee communications between users and Advertisers.

Results may be ordered by relevance, listing completeness, recency, price, location, interactions, or user-selected filters.

Batoo may offer paid sponsored placements or highlights, which will be clearly labeled.

The Platform may include AI-generated suggestions (conversational search, ranking, listing enrichment).

Outputs may contain errors or inaccuracies and are provided as informational support, not professional advice.

We use Mixpanel and similar tools to collect usage data (events, clicks, page views, device/IP technical info) to measure and improve the Service.

Details on legal bases, retention, user rights, and cookie preferences are set out in our Privacy Policy and Cookie Policy, which form part of these Terms.

You can manage consent via the cookie banner and your browser settings.

Software, design, trademarks, logos, text, and databases of the Platform belong to Batoo or its licensors.

You are granted a limited, revocable, non-transferable license to use the Service in compliance with these Terms.

Copying, decompiling, systematically extracting data, or creating derivative works is prohibited unless expressly authorized.

To report a violation, write to abuse@batoo.it including the listing URL/ID, description, reasons and evidence, and your contact details.

We will promptly assess and may remove or restrict Content in good faith.

The Service is provided "as is" and "as available."

We do not warrant uninterrupted service, error-free operation, accuracy, or availability of listings/results.

To the extent permitted by law, all express or implied warranties are disclaimed.

To the maximum extent permitted, Batoo shall not be liable for loss of profits, data, goodwill; indirect, special, incidental, punitive damages; or decisions made based on listings or AI outputs.

Subject to non-waivable consumer rights, Batoo's aggregate liability shall be limited to €100 or, if greater, the amount actually paid to Batoo for paid services in the 12 months preceding the event.

Nothing limits liability for intent or gross negligence where prohibited by law.

You agree to indemnify and hold Batoo harmless from claims, damages, costs, and expenses (including legal fees) arising from: uploaded Content, misuse of the Service, or breach of these Terms or third-party rights.

We may suspend or terminate access in case of violations, security risks, authority requests, or Service discontinuation.

You may close your account at any time via settings or by contacting us.

We may update these Terms. Changes take effect upon publication or the stated date; material changes may be announced (e-mail, banner).

Continued use of the Service constitutes acceptance of the updated Terms.

Professional Advertisers must comply with applicable laws (mandatory disclosures, consumer rights, price advertising, fair commercial practices).

Batoo may request proof of professional status and limit or remove non-compliant content.

These Terms are governed by Italian law.

Exclusive jurisdiction shall lie with the Courts of Milan, without prejudice to the consumer's mandatory forum where applicable.

• Assignment: we may assign this agreement in connection with corporate transactions.
• Severability: invalidity of one clause shall not affect the remainder.
• Force majeure: we are not liable for events beyond reasonable control.
• No waiver: failure to enforce a right does not constitute a waiver.
